Welcome to the SGCOIN Whistleblowing Channel SGCOIN
Here you can safely report infractions and acts of corruption or related infractions under the terms of the General Regime for the Protection of Whistleblowers, approved by Law no. 93/2021, of December 20, as well as the General Regime for the Prevention of Corruption, approved by Decree-Law no. 109-E/2021, of December 9.
What is the complaints channel?
The whistleblowing channel is an online platform for registering and processing complaints, and is an essential tool for uncovering all types of corruption and related offenses.
Who can report it?
Governing bodies, employees, service providers, contractors, subcontractors and suppliers, volunteers and trainees, as well as any persons acting under the direction or supervision of the SGCOIN may be considered whistleblowers.
What can be reported?
Complaints relating to matters within SGCOIN’s remit will be considered, namely acts of corruption and infractions committed, which constitute violations of an ethical, deontological or legal nature that are being committed, as well as attempts to conceal such infractions in the following contexts: harassment, discrimination, fraud, theft or robbery, product safety and compliance, public procurement, safety of the institution’s fleet, protection of the environment, safety of food for human consumption, public health, breach of confidentiality, protection of the privacy of personal data and security of the network and information systems, the other infractions referred to in article 2 of Law no. 93/2021 of December 20.
What are the essential elements of the complaint?
The complaint must essentially include the following elements:
- A brief, objective and clear description of the facts that are the subject of the complaint;
- Indication of the places and dates when the facts occurred;
- Who is involved in the facts with an indication of the identity(ies) and functions of the people involved by suspicion or authorship and those who know the most about the facts (potential witnesses);
- Sending evidence of the facts complained of or how to obtain it.
Handling the complaint
The complaint submitted will be subject to technical analysis by the person responsible for handling the complaint:
- Filing for lack of wrongdoing or lack of evidence that would allow the investigation to continue;
- Open an internal investigation or notify the competent authorities to investigate the infraction;
What protection is granted to the whistleblower?
Confidentiality about the identity of the whistleblower is guaranteed, under the terms of article 18 of Law 93/2021, of December 20, unless there is a legal obligation or court decision.
The processing of the complainant’s personal data will comply with the provisions of Article 19 of Law 93/2021, of December 20.
The whistleblower benefits from the protection and support measures, as well as the guarantees provided for, respectively, in articles 22 and 23 of Law no. 93/2021, of December 20.
The whistleblower also benefits from the liability regime provided for in article 24 of Law no. 93/2021, of December 20.
Whistleblowers’ rights and duties
Through this channel you can anonymously and/or confidentially share your knowledge or suspicion of an irregularity, illegality or crime at your institution.
We encourage you to report any irregular, illegal or illicit facts or situations, as they represent an ethical, professional and citizenship duty, which are important SGCOIN values.
In this way, you are helping to make your institution safer, fairer and more transparent.
All users of this channel are protected by law, prohibiting any kind of retaliation, ensuring anonymity (if desired) and/or confidentiality. The security of shared information is guaranteed and only people exclusively designated by the organization and required by law will have access to it. Complaints must be made in good faith. Misuse and/or making false statements is serious and undermines the purpose of this channel, and may result in sanctions. We recommend that you regularly contact and provide any clarification requested by the person responsible for the whistleblowing channel.
If you wish to provide any personal data that allows you to be identified, you can later exercise your data protection rights. If you have reasonable grounds to believe that the complaint cannot be properly analyzed or resolved within the institution, or that there is a risk of retaliation, you may use alternative channels, such as contacting the competent authorities.
